Appellant, David Michael Farris II, was charged with trafficking in five pounds or more of marijuana while in possession of a firearm and in possession of drug paraphernalia . A jury found Appellant guilty of the charged offenses and he was sentenced to a total of twenty years.

Appellant was sentenced to two consecutive fifteen-year terms of imprisonment by the Fulton Circuit Court after having been convicted of two counts of trafficking in a controlled substance in the first-degree, second offense . The charges stemmed from two separate sales of cocaine to a confidential informant .

Appellant, Christopher Florence, was convicted in the Fayette Circuit Court of one count of Criminal Possession of a Forged Instrument in the second degree, two counts of Theft by Deception Over $300, and Persistent Felony Offender (PFO) in the first degree. The final judgment sentenced Appellant to a total of twenty years' imprisonment. Appellant appeals to this Court as a matter of right.

In 1993, the Laurel Circuit Court imposed two death sentences upon Appellant, Robert Foley, pursuant to convictions for the murders of Harry Lynn Vaughn and Rodney Vaughn. The convictions and sentences were affirmed by this Court on direct appeal in Foley v . Commonwealth , Ky., 942 S .W.2d 876 (1996), cert. denied , 522 U .S . 893 (1997). The trial court's denial of Appellant's motion for RCr 11 .42 relief was subsequently affirmed in Foley v. Commonwealth , Ky., 17 S.W.3d 878 (2000), cert. denied , 531 U .S. 1055 (2000).
