Reyes v. Com., 2002-SC-0600-MR - Not Published, Affirming -- PDF

Appellant, Emilio Cameso Reyes, was convicted in the Fayette Circuit Court of murder and tampering with physical evidence. He was sentenced to life imprisonment and appeals to this Court as a matter of right. Finding no error, we affirm .

Riggs v. Com., 2002-SC-000880-MR - Not Published, Affirming -- PDF

Appellant, James Melvin Riggs, was convicted of first-degree sexual abuse and first-degree sodomy in connection with the sexual molestation of his then stepdaughter . Appellant received five years on the sexual abuse charge and twenty years on the sodomy charge to run concurrently for a total of twenty years imprisonment. He was acquitted of the same charges brought in connection with his biological daughter. He appeals to this Court as a matter of right. Ky. Const . § 110(2)(b) .

Riley v. Com. ; 2001-SC-000753; Published; Affirming -- PDF

Appellant Freeland Thomas Riley was convicted by a McCracken Circuit Court jury of one count of possession of marijuana and one count of possession of drug paraphernalia, both Class A misdemeanors . KRS 218A .1422(2); KRS 218A.500(5) . Each offense was enhanced to a Class D felony by the jury's additional finding that Appellant was in possession of a firearm at the time the offenses were committed. KRS 218A .992 (1)(b) .

Appellant, Kevin Ray Roberts, entered a conditional guilty plea to the charges of manufacturing methamphetamine, possession of marijuana, possession of drug paraphernalia first offense, and of being a second degree persistent felony offender. He was sentenced to twenty-two years imprisonment. He appeals as a matter of right.

Rodriguez v. Com., 2001-SC-000345 - Published, Affirmed -- PDF

Appellant, Joseph Manuel Rodriguez, was convicted of first-degree robbery and sentenced to twenty years' imprisonment. He appeals to this Court as a matter of right. Ky . Const. § 110(2)(b) . On appeal, Rodriguez raises three issues: (1) the police employed an unconstitutional identification procedure, (2) the trial court erred in admitting evidence that he stole a truck and fled the scene after the robbery, and (3) the trial court erred in denying his motion for a new trial on grounds that a juror failed to answer a question that would have caused the juror's disqualification .

Rogers v. Com., 2000-SC-000103-MR - Not Published, Affirming, Vacating in Part, and Remanding -- PDF

Appellant, Alex Rogers was convicted of first-degree robbery, first-degree assault, and attempted murder in the Boyd Circuit Court. He was sentenced to sixteen and one half years, thirteen years, and twenty years, respectively. The sentence for assault was to run consecutively with the robbery sentence and the combined terms were to run concurrently with the attempted murder sentence for a total of twenty-nine and one-half years imprisonment. This appeal is as a matter of right.

Hon . Marc I . Rosen, Judge, Boyd Circuit Court & Commonwealth Of Kentucky (Real Party In Interest) V. Joseph Watson ; 2002-SC-000057-MR; Published; Affirmed; -- PDF

Appellee Joseph Watson is charged with escape in the second degree, a Class D felony, KRS 520 .030(2) . After the Boyd Circuit Court denied his motion to dismiss for failure to comply with his request for final disposition, KRS 500 .110, Appellee petitioned the Court of Appeals for relief pursuant to CR 76 .36. The Court of Appeals granted the petition and issued a writ prohibiting the Boyd Circuit Court from continuing the prosecution of the escape charge. Appellants appeal from that action as a matter of right. Ky. Const . § 115; CR 76 .36(7)(a). We affirm .

Rouse v. Com., 2002-SC-000298-MR - Not Published, Affirming -- PDF

A jury of the McCracken Circuit Court convicted Appellant, Brennan Rouse, for the crime of murder in connection with the Paducah nightclub shooting of Delvecchio A. Ware . The jury fixed the sentence for this crime at life imprisonment. Appellant now appeals to this Court as a matter of right. Ky. Const. § 110(2)(b) .
